Judge upholds overall discipline for police officer

A Denver District Court judge ruled this week that the city's manager of safety need not define specific punishments for each offense when police officers are deemed to have broken multiple rules.
The judge made the ruling regarding the 10-month suspension of Denver officer James Turney in the July 2003 fatal shooting of a developmentally disabled teenager holding a knife. Turney appealed the suspension to the city's Civil Service Commission, which last month asked Manager of Safety Al LaCabe to apportion parts of the suspension to each of Turney's alleged infractions. The judge ruled that no part of Denver's city charter requires the manager of safety to do so. The appeal now goes back to the Civil Service Commission. "We're very pleased that the court agreed with our contention that the manager of safety does have the authority to impose discipline in the manner he sees fit," City Attorney Cole Finegan said. |
